The main object of tho bill Is to protect laborers in their just dues when tho property of their employ ers hits been seized upon for dobts, aud is as follews: A bill for an act to protect em ployes aud laborers In their claims for wages. Bo It enacted by tho leclslatlvo assembly of the stato of Oregen: Sec. 1. That hereafter when tho property of any company, corpora tion, Arm or person shall bo seized upon by any process of any -court of this slate; or where their business shall bo suspended, or tbelr business or property placed in tbo hands of a receiver or trustee, or wbeuover any assignment for tho beuellt of creditors under the laws of this stato Bball be made, then In all such cases tho debts owing to laborers or em ployes which have accrued by rea son of their employment to an amount not exceeding $100 to each employe for work or labor performed within ninoty days next preceding tho seizure, or transfer, or assign ment of such property, shall be (con sidered and treated as preferred debts, and such laborers or employes shall bo preferred creditors and Bhall first bo paid In full. And if there Is not sufficient to pay them in full then tho samo shall bo paid to them pro rata, after paying costs, Any buou laboror or employe de siring to enforce his or herolalm un der this act shall present a state ment, under oath, showing the amount due, after allowing all just credits and set-offs, tho kind of work for which such wages aro due, and when performed, to tho officer or person charged with the oxecutton of su'ih process, within ton days af ter tho seizure thereof, on nuy exe cution, or writ of attachment, or wlfjiin thirty days after tho same may havo been placed in tho bands of auy trustee, assignee or receiver, aud thereupon such person claim luc tlm benefit of this act shall serve upon the debtor, or npou tho officer, trustee, assigneo or receiver of tho dobtor, when porsonal Bervlco can not bo had, a copy of such verified claims. Thereupon it shall bo tho duty of tho person or court "receiv ing such statement, to pay tho amount of such claim or claims to tho persou or porsons entitled there to, after pnyluu all costs occasioned by tho seizure of such property, or of such receivership, or assignment, or trust, out of the proceeds of tho sale of tho property so seized, aaslgu- ed or placed In tho hands of an as signee, receiver or trustee; provided, tbat any person interested may con test any such clulm or claims, or any part thereof, by filing exceptions thereto, supported by affidavit, with tho officer or person having the cus tody of such property, aud there upon tho claimant shall bo required to establish his or her claim by Judg inent In any court having Jurisdic tion before any part thereof shall be paid.
