THE INITIATIVE AND REFERENDUM WAS A REPUBLICAN MEASURE. The reform known as Direct Legislation was inaugurat ed and submitted to the people by Republican legislatures, Furthermore it was endorsed and approved in Republi can conventions under the good old "representative" sys tem. v Under its operation the people have secured the Direct Primary law and the Direct Election of United States Sena tors, , The further fact is in our political history well authenti cated that the Oregonian consented to, connived for and helped adopt these things that are now called bad and revo lutionary. ' If the Oregonian now tells the truth about the evil effects of these reforms, which we deny, the party needs nothing so much' as new leadership, and a new party organ, The party leadership is stulifying itself when it cries out against the progressive reforms that have been secured un der the Initiative and Referendum, ' The alleged leading lights of Republicanism are disown ing the offspring of their own political virtue and kickng their own children out of doors. ...w,w.,-, .,..,.. ' But it is useless to go into all that, The questions is to day: Shall the party abandon its legitimate offsoring, the weapons it created and placed in the hands of the electorate? Or shall the Republican partv stand by its record of hav ing given the people of -Oregon the most progressive and ef ficient tools for self-government? Who is crying out against Direst Legislation, the Direct Primary, and Direct Election of Senators in Oregon, anvway? Isn't it the big inetrests, the hig corporations that have ruled in conventions, that have dictated nominations, that have controlled legislatures, and have elected their own agents . to the United States Senate? , , Come now, be honest, didn't you bite off too big a mouth ful, and don't it set hard on. your stomachs, and haven't vou got sick of a game you did not understand when you went into it? If you were more or less honest and intelligent you would quit kicking vourselves in the face and pleading the baby act saying you didn't know it was loaded. Let us be proud of our record in giving the people re form measures, OUR SUPREME COURT. But who is to judge? Shall it be the journalist or the judge. This must be left to the legal fraternity on the bench or off, mostly on. , . r , , The literal interpretation of the constitution of this state means that the supreme court shall consist of three judges, except to those minds distorted by legal haggling or legal construction. . , There is also no question but that .this state needs five judges in the appellate court. The state would have had a constitutional amendment permitting five judges at the last election had it not been for the Oregonian and a Salem lawyer with an ambition to sit on the bench, who but a few days before election wrote a let ter published in the Oregonian that decried the constitutional amendment for the reason that it did not limit the number of supreme judges, A shallower,- cheaper- or more . unreasonable, argument could not have been made, But all things have their effect as this did. The legislature passed a law increasing the bench, though the amendment failed. What is. the remedy? Shall it be a literal constitutional interpretation against the language of the instrument, or shall common sense out weigh technicality? Medford Mail Tribune, The above editorial is sound excent that it overlooks the fact that plain common sense will allow five justices, I he Constitution says three justices shall constitute the supreme court, But it nowhere says there shall never be more than three justices of the supreme court, I he clear rule of Interpreting a state constitution is that the legislature has all the powers that the constitution does not prohibit it from exercising. If the constitution said the supreme court shall consist ui unuc juouuco aim iicvoi, uhucai any ouiiiolcuiooo, shall the legislature or the people create more than three, there would be some ground fo rthe Oregonian to argue. But such a constitution would be ridiculous and impos sible. Has it ever dawned upon the Oregonian that a constitu tion is a growing , living organism, and not a cast-off. Procrustean shell?
