Follow ing tho nnnouncembnt that Francis J. Heney has bgon appointed an as slstant attorney-general to prosecute land fraud cases In Oregon, tho speeoh of ex-Senator Charles W Ful ton before 300 'niembers of the Ore gon Bar Association yesterday cre ated a sensation. Without alluding to Judgo Dunne Or Francis J. Honey by name in his address, Fulton excoriated tho trial judge and prosecutor In tho case of the people of California against Eu gene Schmitz, saying that the prose cutor was unfair, and that the trial judge showed a disregard of the rights of the defendant to a fair and impartial jury. Tho speaker averred that tho nn pellate court of California did oniv its duty when it reversed the verdict of .guilty against former Mayor ocunuiz, or aan rnncisco. Fultou said in part: "I state withdut any reservation whatever, as a result of careful read ing and consideration of the de cision, that had the court failed to decide as it did, It would havo dis credited itself and the judiciary of the country. "They could not have declrlfui otherwise without violating thnlr official oaths and pleading pruiltv to a degree of cowardice and pusillan imity mat would nave justly learned for them the enduring contemnt of the bench and bar ofthe nation. "I do not contend that the record disclosed the innocenco of Schmitz. I do contend, however, that he was entitled to a. fair and impartial trial, and that the record disclosed not only that he had. been denied such, but that the character of tho trial in tho lower court, in its utter disre gard of the most simple and elemen tary principles .of justice and decen cy, was rarely ever surpassed Jeff rey in his most vigorous and vicious examples of judicial tyranny and de pravity." o :t 'fi : PERSONAL MENTION tfi TV.i otic? i wi, b rcccfvcTaflf Security Savi,?
