O'Day, appearing as counsel for Sam Coqliran, In tho caao of tho state vs. Cochran, filed a brief In tno suprome court in which the constitutionality of the act of the deglslature increasing tho Justices of the supfemo court from three to llvo members is tho princi pal issue. Martin L. Pipes also ap pears with Judge O'Day (amicus curiae) affirming the constitutional ity of the act. Tho appellant In this caso was in dicted under the local option law for selling intoxicating liquors In the city of St. Johns. It is claimed on behalf of the defendant that tho local option law in tho territory comprising St. Johns was amended by tho incarporation of St. Johns by a special charter and that tho lo cal option law was not applicable to the city. The caso was then ap pealed to the supreme court and the conviction of tho defendant was re Mersed by a divided court. It so happened, states the brief, that ono of tho Justices of the court as formerly constituted, and the two Justices appointed under tho act of tho legislature concurred In the re versal, while two constituting tho court as formerly organized, dis sented. Tho attorney general and the dep uty district attorney of Multnomah county filed a motion requesting the court to enter an order making the opinion of tho dissenting Judges tho majority opinion and to enter a mandato that tho Judgment of the lower court was affirmed, claiming that tho act of the legislature in adding two Justices of the supreme court wus unconstitutional and void, and the Justices so added were not Justices of tho court. NEWSPAPERS AND THE U, S, MAIL May Be Delivered on the Re stricted Sidewalks The Mayor So Orders. The daily newspaper publishers of this city had a conference with Mayor Itodgers, and he conceded that the delivery of the mails and news papers was In the nature or a puuue service, and the people would be de prived of a great convenience and accommodation if the sidewalks were not allowed to bo used on botn sides of the streets for this purpose. The papers are delivered early in tho morning and late at night, and there have been no complaints In many years of the letter carriers and dnlly newspaper carriers running in to anyone, and, while this is not to apply to tho business part of the city, the mayor says there will be no more arrests in tho residence parts of the city of these two classes of carriers, but the law will be strictly enforced in the restricted districts as to all others. The newspaper and mail people were preparing to carry the case into the courts, and this amicable settlement is far better. The bicycle ordinance is the best one the city can have under all the circumstances, and Its practical and reasonable enforcement without de priving the general public of news paper cf mall delivery is the best condition for all.
